By requesting or booking training services with us, you agree to be bound by these Terms. Please read them carefully before confirming a booking.
OperatorPro provides on-site plant and safety operator training and certification services across the UK, including but not limited to:
All training is delivered in line with current HSE guidance and relevant industry standards. Certification is awarded through recognised accreditation bodies (including CPCS and NPORS, as applicable). We reserve the right to modify the content or structure of any course to reflect updated legislation, guidance or best practice.
3.1 All quotations provided by OperatorPro are valid for 30 days from the date of issue, unless otherwise stated.
3.2 A booking is confirmed only when we have issued a written confirmation (by email). We reserve the right to decline any booking at our discretion.
3.3 Where a purchase order is required by the Client, this must be provided prior to the training date. Our standard payment terms apply regardless of any delay in issuing a purchase order.
3.4 Quotations are based on the information provided at the time of enquiry. We reserve the right to revise a quotation if the scope of training changes materially (for example, additional operators, different equipment, or a change of location).
4.1 Prices are as quoted and are exclusive of VAT unless otherwise stated. VAT will be charged at the prevailing rate.
4.2 Payment is due within 30 days of the date of invoice unless otherwise agreed in writing.
4.3 We reserve the right to charge interest on overdue amounts at 8% per annum above the Bank of England base rate, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
4.4 We reserve the right to withhold certification documentation until payment has been received in full.
To allow us to deliver training safely and effectively, the Client agrees to:
Failure to meet these responsibilities may result in the training being curtailed or cancelled. In such circumstances, the full course fee remains payable.
6.1 We understand that operational requirements change. Cancellation and rescheduling terms are as follows:
6.2 Notice must be given in writing to info@operatorpro.co.uk. The notice period is calculated from the date the written notification is received.
6.3 Where a booking is rescheduled (rather than cancelled outright), no cancellation fee applies provided at least 14 days' notice is given. Rescheduling with less than 14 days' notice will incur the charges above, with any payment credited against the rescheduled booking.
6.4 If an operator fails to attend on the day without prior notice, the full course fee for that delegate is payable.
7.1 We reserve the right to cancel or reschedule a booking in exceptional circumstances, including but not limited to instructor illness, extreme weather, or circumstances outside our reasonable control.
7.2 In such cases, we will notify you as soon as practicable and offer an alternative date at no additional cost, or a full refund of any monies paid.
7.3 We shall not be liable for any consequential losses arising from a cancellation by us in exceptional circumstances.
8.1 Certification is awarded solely on the basis of each operator's performance during the training and assessment. OperatorPro cannot guarantee that every delegate will achieve certification.
8.2 Where an operator does not meet the required standard, we will advise on the recommended next steps. A re-assessment fee may apply.
8.3 Certificates are issued in the name of the individual operator. Responsibility for ensuring that all operators attending are the persons named on any booking rests with the Client.
8.4 It is the Client's responsibility to verify that operators hold valid, current certification before permitting them to operate plant and equipment.
9.1 Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.
9.2 Subject to clause 9.1, our total liability to the Client in connection with any booking shall not exceed the total fees paid or payable by the Client for that booking.
9.3 We shall not be liable for any indirect, consequential, or special losses, including loss of profit, loss of production, or loss of business, even if we were advised of the possibility of such losses.
10.1 Our instructors are entitled to stop training immediately if, in their professional judgement, the training environment poses a risk to health and safety. The full course fee remains payable in such circumstances.
10.2 The Client is responsible for ensuring compliance with all applicable health and safety legislation at the training site, including the Health and Safety at Work etc. Act 1974 and associated regulations.
All training materials, course content and documentation provided by OperatorPro remain our intellectual property. You may not copy, reproduce or distribute our materials without our prior written consent.
We process personal data in accordance with our Privacy Policy and applicable data protection law, including UK GDPR.
Neither party shall be liable for any delay or failure to perform their obligations under these Terms if that delay or failure results from circumstances beyond their reasonable control, including acts of God, pandemic, government restriction, or severe weather. The affected party shall notify the other as soon as reasonably practicable.
These Terms are governed by the laws of England and Wales. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
We reserve the right to update these Terms from time to time. The current version will always be published on this page with the date of last revision. Continued use of our services following any change constitutes acceptance of the revised Terms.
